Alternative Approval Process

Notice to Electors of the Town of Ladysmith of an Alternative Approval Process for a Proposed Extension of Town Boundaries.

Notice is hereby given that under section 86 (Alternative Approval Process) of the Community Charter and section 12 of the Local Government Act, the Council of the Town of Ladysmith intends to petition the Minister of Municipal Affairs and Housing to request an extension of the area of the municipality to include the following described lands:

1. Lot 20, District Lot 41, Oyster District, Plan 2519, except parts in Plans 8993, 43985 and EPP28332

2. Lot 1, District Lot 41, Oyster District, Plan 8804 except part in Plans 43985 and VIP55838 and that part of Lot 17, District Lot 41, Oyster District, Plan 2519 lying to the west of westerly boundary of Plan 1057RW

Rationale — the property owners have requested inclusion of the subject properties for the purpose of future residential development and access to municipal services.

Alternative Approval Process and Eligibility

The municipality may proceed with the boundary extension request to the Province unless at least ten percent of municipal electors indicate that a referendum must be held by submitting a signed Elector Response Form to the Ladysmith City Hall no later than 4:00 p.m. on Wednesday, June 6, 2018. Elector Response Forms must be in the form established by the Town of Ladysmith, and only those persons who qualify as electors of the municipality are entitled to sign Elector Response Forms. Forms may be submitted in person at City Hall, through the mail (to Town of Ladysmith, P.O. Box 220, Ladysmith, B.C., V9G 1A2) by fax to 250.245.6411 or via email to: elections@ladysmith.ca.

Resident Elector — You are entitled to submit an Elector Response Form as a resident elector if you are age 18 or older on the day of submission, are a Canadian citizen, have lived in B.C. for at least six months, and have been a resident of the Town of Ladysmith for the past 30 days or more.

Non-Resident Elector — You are entitled to submit an Elector Response Form as a non-resident property elector if you are age 18 or older on the day of submission, are a Canadian citizen, have lived in B.C. for at least six months, have owned and held registered title to a property in the Town of Ladysmith for the past 30 days or more, and do not qualify as a resident elector.

Note: Only one non-resident property elector per property may submit an Elector Response Form, regardless of how many owners there may be.

If less than ten percent (664) of municipal electors submit an Elector Response Form, the boundary extension request will be deemed to have the approval of the electors, and the proposal may proceed to the Minister of Municipal Affairs and Housing for consideration. For the purpose of conducting the alternative approval opportunity, the number of electors is calculated as 6,635.

between the hours of 8:30 a.m. and 4:00 p.m. weekdays.

ELECTORAL AREA BOUNDARY CHANGES – REGIONAL DISTRICT OF MOUNT WADDINGTON

Notice is hereby given that Order in Council No. 215 was approved and ordered on April 27, 2018 authorizing an amendment to Letters Patent for the Regional District of Mount Waddington, effective from the date of the Order, to alter the boundaries of electoral areas A, B, C and D. These amendments are authorized under section 41 of the Local Government Act [R.S.B.C. 2015].

A copy of the Letters Patent, including maps of the revised Regional District of Mount Waddington electoral areas, may be viewed or obtained from the Governance and Structure Branch of the Ministry of Municipal Affairs and Housing, 800 Johnson Street, PO Box 9839 STN Prov Govt, Victoria, BC, V8W 9T1 or viewed at the offices of the Regional District of Mount Waddington, located at 2044 McNeill Road, Port McNeill, BC, during normal hours of operation.
