Notice issued by the Board of Management of the Association of British Columbia Land Surveyors

Notice issued pursuant to section 65 of the Land Surveyors Act, RSBC 1996, c.248

Arising out of two complaints originating from the Office of the Surveyor General and the Practice Advisory Panel, Brad Cunnin, BCLS #677, was summoned before the Board of Management on 6 September 2018 to answer fifty-nine (59) separate counts alleging both unprofessional conduct and various breaches of Bylaw 14.1(b), 14.1(c)(i), Bylaw 14.4, Bylaw 16(e), and Bylaw 16(f)(ii). Mr. Cunnin did not dispute any matter alleged in the Summons. Having considered the underlying facts and submission from Mr. Cunnin and the Complaint Inquiry Committee, and in view of Mr. Cunnin’s lengthy discipline history, the Board has ordered that Mr. Cunnin be:

(a) censured according to section 60(1)(a) of the Land Surveyors Act for breach of bylaws;

(b) expelled from the Association according to section 60(2)(b) of the Land Surveyors Act, for unprofessional conduct.

Mr. Cunnin’s name has been deleted from the roster of land surveyors maintained by the Association, and his Juricert credentials revoked. Mr. Cunnin is no longer entitled to use the designation of “land surveyor”, or the initials “B.C.L.S.”, and he is permanently enjoined, according to section 60(2)(f) of the Land Surveyors Act, from applying for reinstatement to practice land surveying. Mr. Cunnin has also been ordered to pay all costs of this matter within thirty (30) days following receipt of a certificate of costs from the Secretary.
