Boundary Extension – City of Fernie
And
Service Transfer – Regional District of East Kootenay
Notice is hereby given that Order in Council No. 0596 was approved and ordered on December 18, 2017, authorizing:
1. An amendment to Letters Patent for the City of Fernie, effective December 18, 2017, extending the boundary of the City to include 114 properties located north of Highway 3, and bounded by the Elk River, in the area of the former West Fernie Waterworks District. Provision of a tax rate limit for those properties formally within the West Fernie Waterworks District, for a transitional period until 2021. In addition there is a local area service provision that covers the area of the former Waterworks District (see Schedule 4 of the City’s Letters Patent). The authorizing legislative provisions are sections 12 [Extension of municipal area], 29 [Establishment of property tax rate limits], and 31 [Establishment of local area service] of the Local Government Act [R.S.B.C. 2015].
2. An amendment to Letters Patent for the Regional District of East Kootenay effective December 18, 2017, to reduce the boundary of Electoral Area A to exclude the area above and transfer relevant service jurisdiction to the City. This amendment is authorized under section 44 [Creation or restructure of municipality in regional district] of the Local Government Act [R.S.B.C. 2015].
A copy of the amendment to these Letters Patent, which includes a map of the City of Fernie noting the area of extension, may be viewed or obtained from the Governance and Structure Branch of the Ministry of Municipal Affairs and Housing, 800 Johnson Street, PO Box 9839 STN Prov Govt, Victoria, BC V8W 9T1 or viewed at the offices of the City of Fernie, located at 501 3rd Avenue, Fernie, BC V0B 1M0, during normal hours of operation.
