Definition

0.1   In this regulation, "adopting regulation" means the Railway Safety Adopted Provisions Regulation, B.C. Reg. 210/2004.

Delegation to British Columbia Safety Authority

1   (1) For the purposes of sections 2 and 6 of the Railway Safety Act, the administration of the Railway Safety Act is delegated to the British Columbia Safety Authority, except for

(a) sections 3, 11, 12 and 20 and Parts 4 and 5, and

(b) section 19 (0.1) of the Canadian Transportation Accident Investigation and Safety Board Act, adopted by section 5 of the adopting regulation.

(2) Despite subsection (1), the administration of provisions that is otherwise delegated by this regulation is not delegated to the British Columbia Safety Authority.

Delegation to the Canadian Transportation Accident Investigation and Safety Board

2   (1) In this section:

"board" means the Canadian Transportation Accident Investigation and Safety Board established by section 4 of the Canadian Transportation Accident Investigation and Safety Board Act;

"common carrier" means a railway that is neither a commuter railway nor an industrial railway;

"commuter railway" means a railway operated by or on behalf of the Greater Vancouver Transportation Authority to transport passengers for a toll or fee;

"industrial railway" means a railway authorized by a permit under section 11 of the Railway Safety Act to operate as an industrial railway.

(2) Subject to section 1, the administration of the following provisions is delegated to the board:

(a) the provisions of the Canadian Transportation Accident Investigation and Safety Board Act adopted by section 5 of the adopting regulation, except for section 23 (1) of that Act;

(b) the provisions of the Transportation Safety Board Regulations, SOR/2014-37, adopted by section 6 of the adopting regulation, except for section 5 of those regulations;

(c) section 5 of the Transportation Safety Board Regulations, SOR/2014-37, but only with respect to common carriers.

Delegation to the Canadian Transportation Agency

3   (1) In this section, "agency" means the Canadian Transportation Agency continued by section 7 (1) of the Canada Transportation Act.

(2) Subject to sections 1 and 2, the administration of the following provisions is delegated to the agency:

(a) the provisions of the Canada Transportation Act adopted by section 7 of the adopting regulation;

(b) sections 16 (1), (3), (4), (4.1) and (6) and sections 26 (1), (3) and (4) of the Railway Safety Act (Canada), adopted by section 3 of the adopting regulation.
