Counter Petition Exemption Regulation

 Section 334.1 (2) of the Local Government Act

1  Section 334.1 (2) [counter petition opportunity required for liabilities under long term agreements] of the Local Government Act does not apply to an agreement under which the municipality acquires an interest or right in or with respect to land if the liability in relation to which that provision would otherwise apply is only one or both of

(a) an obligation that the municipality maintain the land, or

(b) an obligation that the municipality indemnify the grantor of the interest or right being acquired by the municipality.

 Section 828 (3) of the Local Government Act

2  Section 828 (3) [counter petition opportunity required for liabilities under long term agreements] of the Local Government Act does not apply to an agreement under which the regional district acquires an interest or right in or with respect to land if the liability in relation to which that provision would otherwise apply is only one or both of

(a) an obligation that the regional district maintain the land, or

(b) an obligation that the regional district indemnify the grantor of the interest or right being acquired by the regional district.
