Delegation of Capital Regional District
Hearings under Section 700 of the
Municipal Act Regulation

Delegation of hearings

1   (1) The Capital Regional District board is granted the power to delegate the holding of a hearing under section 700 of the Act, a specified class of those hearings or those hearings generally.

(2) A delegation under this section may be to one or more directors or alternate directors, identified specifically or by the municipalities or electoral areas that they represent.

(3) A delegation under this section in relation to a class of hearings or hearings generally does not apply to a hearing unless

(a) the delegation was established before notice of the hearing was given under section 700 of the Act, and

(b) the resolution or bylaw establishing the delegation is available for public inspection.

(4) For certainty, if a delegation has been made in relation to a class of hearings or hearings generally, the board may exercise its authority under subsection (1) to change that delegation to a different delegation in relation to a specific hearing.

(5) If the holding of a hearing has been delegated, the board must not act under section 700 (3) of the Act on the matter that is the subject of the hearing until the delegate reports to the board the views expressed at the hearing.

(6) A report under subsection (5) may be made orally or in writing.
