Definitions and interpretation

1   (1) In this regulation:

"Act" means the Wildlife Act;

"ATV" or "all terrain vehicle" means a wheeled or tracked motor vehicle that is capable of travel on or off a highway, including a motorcycle, but not including

(a) a snowmobile, or

(b) a motor vehicle that is licensed for highway travel under the Motor Vehicle Act;

"electric bicycle" means a wheeled device

(a) on which a person may ride,

(b) to which pedals or hand cranks are attached that allow the device to be propelled by human power, and

(c) to which a motor is attached that allows the device to be propelled by electric power;

"existing road or trail" means

(a) a road or trail with a paved surface,

(b) a cross-country or downhill ski route marked in a ski area by the owner of the ski area,

(c) a road used for logging or mining,

(d) a road or trail used for access to fences, power lines, wind generators or communication towers, or

(e) a trail on which there is no vegetation except on a strip that, if present, can be straddled by a 4-wheel vehicle;

"highway" has the same meaning as in the Motor Vehicle Act;

"motor vehicle" means a device in, on or by which a person or thing is or may be transported or drawn, and which is designed to be self-propelled, including an electric bicycle, but not including any of the following:

(a) another device designed to be propelled by human, animal or wind power;

(b) a device used exclusively on stationary rails or tracks;

(c) a boat;

(d) an aircraft;

"motorcycle" has the same meaning as in the Motor Vehicle Act;

"M.U." or "management unit" means an area designated as a management unit by the Management Unit Regulation;

"related transportation activity" means the following activities related to hunting:

(a) transporting a hunter;

(b) transporting game;

(c) transporting equipment or supplies, including a firearm or bow, intended to be used for or in support of hunting;

"snowmobile" means a motor vehicle designed for travel primarily on snow or ice, that has one or more steering skis and that uses one or more endless tracks driven in contact with the ground.

(2) In this regulation,

(a) a reference to a specific map is a reference to the map listed in column 1 of Schedule 8, and

(b) a description set out opposite in column 2 of Schedule 8 is listed for ease of reference only.

(3) If a period specified in a schedule to this regulation ends on February 28, the period ends instead on February 29 if the year in which the period ends is a leap year.

Areas closed to motor vehicles

2   Unless permitted by section 9 or 10 or a section of Schedule 1, a person must not use or operate a motor vehicle in an area described in Schedule 1 during the period specified in that schedule for the area.

Areas closed to hunting with motor vehicles

3   Unless permitted by section 9 or 10 or a section of Schedule 2, a person must not use or operate a motor vehicle for the purpose of hunting or a related transportation activity in an area described in Schedule 2 during the period specified in that schedule for the area.

Areas closed to ATVs, electric bicycles and snowmobiles

4   Unless permitted by section 9 or 10 or a section of Schedule 3, a person must not use or operate an ATV, electric bicycle or snowmobile in an area described in Schedule 3 during the period specified in that schedule for the area.

Areas closed to hunting with ATVs, electric bicycles and snowmobiles

5   Unless permitted by section 9 or 10 or a section of Schedule 4, a person must not use or operate an ATV, electric bicycle or snowmobile for the purpose of hunting or a related transportation activity in an area described in Schedule 4 during the period specified in that schedule for the area.

Areas closed to snowmobiles

6   Unless permitted by section 9 or 10 or a section of Schedule 5, a person must not use or operate a snowmobile in an area described in Schedule 5 during the period specified in that schedule for the area.

Areas closed to hunting with snowmobiles

7   Unless permitted by section 9 or 10 or a section of Schedule 6, a person must not use or operate a snowmobile for the purpose of hunting or a related transportation activity in an area described in Schedule 6 during the period specified in that schedule for the area.

Areas closed to hunting with ATVs and electric bicycles

8   Unless permitted by section 9 or 10 or a section of Schedule 7, a person must not use or operate an ATV or electric bicycle for the purpose of hunting or a related transportation activity in an area described in Schedule 7 during the period specified in that schedule for the area.

Exceptions for trapping furbearing animals

9   (1) A person who is authorized to trap under the Act may use or operate a motor vehicle for the purpose of trapping furbearing animals in an area described in any of the following sections of Schedule 1 during the period specified in that schedule for the area:

(a) section 59 [Finlay River];

(b) section 60 [Upper Flathead];

(c) section 61 [Flathead River Eastside, Akamina Creek and Kishinena Peak];

(d) section 63 [Baribeau Creek];

(e) section 77 [Garnet Valley];

(f) section 86 [Clinton Creek];

(g) section 103 [Sanca Creek];

(h) section 104 [Leadville Creek];

(i) section 105 [Dutch Creek and Brewer Creek];

(j) section 133 [Sustut River, Johansen Lake and Moose Valley].

(2) A person who is authorized to trap under the Act may use or operate a motor vehicle for the purpose of trapping furbearing animals in an area described in Schedule 2, 4, 6 or 7 during the period specified for the area in the applicable schedule.

Other exceptions

10   (1) A person may use or operate a motor vehicle on a highway in an area described in any of Schedules 1, 2, 3, 4, 5, 6 or 7, other than an area described in section 116 [Chilko River] of Schedule 1, during the period specified in the applicable schedule for the area.

(2) A person may, for a commercial purpose other than hunting or a related transportation activity or back country recreation, use or operate a snowmobile in an area described in Schedule 5 during the period specified in that schedule for the area.

Offences

11   A person who contravenes section 2, 3, 4, 5, 6, 7 or 8 commits an offence.

Schedule 1

Areas Closed to Motor Vehicles

(Section 2)

Premier Ridge

1   The closure is effective year-round in any portion of M.U. 4-21 outlined in red on Map No. 1-1/23, except that a person may use or operate a motor vehicle

(a) on private property,

(b) on a road shown highlighted in green on that map, and

(c) during the period May 1 to December 31 on a road shown highlighted in yellow on that map.

Spruce Lake

2   The closure is effective during the period June 1 to November 30, in any portion of M.U. 3-32 outlined in dashed red on Map No. 1-2/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Mutton Creek

3   The closure is effective year-round in any portion of M.U. 4-24 outlined in red on Map No. 1-3/23.

McDougall Creek

4   The closure is effective year-round in any portion of M.U. 4-1 outlined in red on Map No. 1-4/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

North Galbraith Creek

5   The closure is effective year-round in any portion of M.U. 4-22 outlined in red on Map No. 1-5/23.

Pickering Hills

6   The closure is effective year-round in any portion of M.U. 4-22 outlined in red on Map No. 1-6/23, except that a person may use or operate a motor vehicle

(a) on a road shown highlighted in green on that map, and

(b) during the period June 1 to August 31 on a road shown highlighted in yellow on that map.

Lac du Bois and Dewdrop

7   The closure is effective year-round in any portions of M.U.s 3-28 and 3-29 outlined in red on Map No. 1-7/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Junction

8   The closure is effective year-round in any portion of M.U. 5-14 outlined in red on Map No. 1-8/23, except that a person may use or operate a motor vehicle

(a) for a commercial purpose other than hunting or a related transportation activity, and

(b) during the period April 1 to November 30 on a road shown highlighted in yellow on that map.

Osoyoos Oxbows

9   The closure is effective year-round in any portion of M.U. 8-1 outlined in red on Map No. 1-9/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Dutch Creek and Findlay Creek

10   The closure is effective year-round in any portion of M.U. 4-26 outlined in red on Map No. 1-10/23, except that a person may use or operate a motor vehicle

(a) on a road shown highlighted in green on that map, and

(b) during the period May 1 to November 30 on a road shown highlighted in yellow on that map.

Sheep Mountain

11   The closure is effective year-round in any portion of M.U. 4-22 outlined in red on Map No. 1-11/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

China Head Mountain

12   The closure is effective year-round in any portion of M.U. 3-32 outlined in red on Map No. 1-12/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Nine Mile Ridge

13   The closure is effective year-round in any portion of M.U. 3-32 outlined in red on Map No. 1-13/23.

Red Mountain and French Mountain

14   The closure is effective year-round in any portions of M.U.s 3-32 and 5-3 outlined in red on Map No. 1-14/23.

Hogback Mountain

15   The closure is effective year-round in any portion of M.U. 3-32 outlined in red on Map No. 1-15/23.

Chauncey Creek and Todhunter Creek

16   The closure is effective year-round in any portion of M.U. 4-23 outlined in red on Map No. 1-16/23, except that a person may use or operate a motor vehicle

(a) on a road shown highlighted in green on that map, and

(b) during the period June 16 to August 31 on a road shown highlighted in yellow on that map.

Powerplant

17   The closure is effective year-round in any portion of M.U. 4-22 outlined in red on Map No. 1-17/23, except that a person may use or operate a motor vehicle

(a) on a road shown highlighted in green on that map, and

(b) during the period May 1 to November 30 on a road shown highlighted in yellow on that map.

Stoddart Creek

18   The closure is effective year-round in any portion of M.U. 4-25 outlined in red on Map No. 1-18/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Columbia Lake

19   The closure is effective year-round in any portion of M.U. 4-25 outlined in red on Map No. 1-19/23, except that a person may use or operate a motor vehicle

(a) on a road shown highlighted in green on that map, and

(b) during the period May 1 to November 30 on a road shown highlighted in yellow on that map.

Eureka Peak

20   The closure is effective year-round in any portion of M.U. 5-15 outlined in red on Map No. 1-20/23, except that a person may use or operate a snowmobile during the period December 1 to April 30.

Underdown Creek

21   The closure is effective year-round in any portion of M.U. 8-1 outlined in red on Map No. 1-21/23.

Goldie Creek

22   The closure is effective year-round in any portion of M.U. 4-26 outlined in red on Map No. 1-22/23.

Grave Prairie

23   The closure is effective year-round in any portion of M.U. 4-23 outlined in red on Map No. 1-23/23, except that a person may use or operate a motor vehicle

(a) on Lot 1, District Lot 2316, Kootenay District,

(b) on a road shown highlighted in green on that map, and

(c) during the period May 15 to September 30 on a road shown highlighted in yellow on that map.

Bullmoose Mountain and Chamberlain Mountain

24   The closure is effective year-round in any portion of M.U.s 7-21 and 7-22 outlined in red on Map No. 1-24/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Skaha Lake Eastside

25   The closure is effective year-round in any portion of M.U. 8-9 outlined in red on Map No. 1-25/23.

Green Mountain Wildlife Management Area

26   The closure is effective year-round in any portion of M.U. 1-5 outlined in red on Map No. 1-26/23.

Elizabeth Lake

27   The closure is effective year-round in any portion of M.U. 4-3 outlined in red on Map No. 1-27/23.

Corbin Creek

28   The closure is effective year-round in any portion of M.U. 4-23 outlined in red on Map No. 1-28/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Knife Creek

29   The closure is effective year-round in any portion of M.U. 5-2 outlined in red on Map No. 1-29/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Cherry Creek and Bummers Flats

30   The closure is effective year-round in any portions of M.U.s 4-20 and 4-21 outlined in red on Map No. 1-30/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Wigwam Flats, Mt. Broadwood and Sportsman Ridge

31   The closure is effective year-round in any portion of M.U. 4-2 outlined in red on Map No. 1-31/23, except that a person may use or operate a motor vehicle

(a) on a road shown highlighted in green on that map,

(b) during the period June 15 to June 30 on a road shown highlighted in yellow on that map,

(c) during the period June 15 to August 31 on a road shown highlighted in purple on that map, and

(d) during the periods November 11 to April 30 and June 1 to August 31 on a road shown highlighted in orange on that map.

Galton Range

32   The closure is effective year-round in any portion of M.U. 4-2 outlined in red on Map No. 1-32/23, except that a person may use or operate a motor vehicle

(a) on a road shown highlighted in green on that map,

(b) during the period September 1 to June 15 on a road shown highlighted in yellow on that map, and

(c) during the periods September 1 to October 21 and November 11 to June 15 on a road shown highlighted in orange on that map.

Linklater Creek

33   The closure is effective year-round in any portion of M.U. 4-3 outlined in red on Map No. 1-33/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Weigert Creek

34   The closure is effective year-round in any portion of M.U. 4-23 outlined in red on Map No. 1-34/23, except that

(a) a person may use or operate a motor vehicle on a road shown highlighted in green on that map,

(b) during the period July 1 to August 31, a person may use or operate an ATV or electric bicycle on a road shown highlighted in yellow on that map, and

(c) a person may use or operate a snowmobile for a purpose other than hunting or a related transportation activity.

Upper Elk Valley and Fording River

35   The closure is effective year-round in any portion of M.U. 4-23 outlined in red on Map No. 1-35/23, except that

(a) a person may use or operate a motor vehicle on a road shown highlighted in green on that map,

(b) during the period July 1 to August 31, a person may use or operate an ATV or electric bicycle on a road shown highlighted in yellow on that map, and

(c) a person may use or operate a snowmobile

(i) in any area other than an area shown hatched in purple on that map, and

(ii) during the period December 1 to April 30 on a trail shown highlighted in purple on that map.

Marsden Face

36   The closure is effective during the period December 1 to April 15 in any portion of M.U. 4-18 outlined in dashed red on Map No. 1-36/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Peace Alpine

37   The closure is effective year-round in any portions of M.U.s 7-19, 7-21, 7-31, 7-35, 7-36, 7-43, 7-53 and 7-57 outlined in red on Map No. 1-37a/23, Map No. 1-37b/23 and Map No. 1-37c/23, except that

(a) a person may use or operate a motor vehicle on the trail shown highlighted in green on Map No. 1-37c/23, and

(b) during the period November 1 to April 30, a person may use or operate a snowmobile for a purpose other than hunting or a related transportation activity.

Alexander Creek

38   The closure is effective year-round in any portion of M.U. 4-23 outlined in red on Map No. 1-38/23, except that

(a) a person may use or operate a motor vehicle

(i) on a road shown highlighted in green on that map,

(ii) during the period June 16 to March 31 on a road shown highlighted in orange on that map, and

(iii) during the period December 1 to August 31 on a road shown highlighted in purple or yellow on that map,

(b) during the period September 1 to November 30, a person may use or operate an ATV or electric bicycle on a road shown highlighted in yellow on that map, and

(c) a person may use or operate a snowmobile for a purpose other than hunting or a related transportation activity in any area other than an area shown hatched in purple on that map.

Granby Wilderness

39   The closure is effective year-round in any portions of M.U.s 8-14 and 8-15 outlined in red on Map No. 1-39/23, except that a person may use or operate a snowmobile during the period November 1 to May 31.

North Churn Creek

40   The closure is effective year-round in any portion of M.U. 5-3 outlined in red on Map No. 1-40/23, except that

(a) a person may use or operate a motor vehicle on a road shown highlighted in green on that map,

(b) a person may use or operate a motor vehicle, other than a snowmobile, for a commercial purpose other than hunting or a related transportation activity, and

(c) during the period December 1 to April 30, a person may use or operate a snowmobile.

Corkscrew Creek

41   The closure is effective year-round in any portion of M.U. 5-12 being the road shown highlighted in red on Map No. 1-41/23, except that a person may use or operate a motor vehicle for a commercial forestry purpose.

Miledge, Chappell and Lempriere Creeks

42   The closure is effective year-round in any portion of M.U. 3-44 outlined in red on Map No. 1-42/23, except that, during the period December 1 to May 31, a person may use or operate a snowmobile

(a) on the trail shown highlighted in yellow on that map, and

(b) in the area outlined in dashed red on that map.

Willow Creek Conservation Area

43   The closure is effective year-round in any portion of M.U. 1-6 outlined in red on Map No. 1-43/23.

Parksville-Qualicum Beach Wildlife Management Area

44   The closure is effective year-round in any portions of M.U.s 1-5 and 1-6 outlined in red on Map No. 1-44/23.

Skull Mountain

45   The closure is effective during the period September 1 to December 10 in any portion of M.U. 328 outlined in dashed red on Map No. 1-45/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Tsatia Mountain

46   The closure is effective year-round in any portion of M.U. 6-20 outlined in red on Map No. 1-46/23.

Klastline Plateau

47   The closure is effective year-round in any portion of M.U. 6-21 outlined in red on Map No. 1-47/23.

Level Mountain Block

48   The closure is effective year-round in any portions of M.U.s 6-22 and 6-26 outlined in red on Map No. 1-48/23.

Gnat Pass

49   The closure is effective year-round in any portion of M.U. 6-19 outlined in red on Map No. 1-49/23.

Tanzilla River

50   The closure is effective during the period May 1 to November 15 in any portion of M.U. 6-19 outlined in dashed red on Map No. 1-50/23, except that

(a) a person may use or operate a motor vehicle if the person accesses the area other than by a road shown highlighted in green on that map, and

(b) in any other case, a person may use or operate a motor vehicle on a road shown highlighted in green on that map and within 400 m of the midline of such a road.

Dease Lake

51   The closure is effective during the period May 1 to November 15 in any portion of M.U. 6-23 outlined in dashed red on Map No. 1-51/23, except that

(a) a person may use or operate a motor vehicle if the person accesses the area other than by a road shown highlighted in green on that map, and

(b) in any other case, a person may use or operate a motor vehicle on a road shown highlighted in green on that map and within 400 m of the midline of such a road.

Hot Lakes, Cassiar, Adsit Lake, Midway Mine and One Ace Mountain

52   (1) The closure is effective during the period May 1 to November 15 in any portion of M.U. 6-24 outlined in dashed red on Map No. 1-52/23, except that

(a) a person may use or operate a motor vehicle if the person accesses the area other than by a road shown highlighted in light or dark green on that map, and

(b) in any other case, a person may use or operate a motor vehicle

(i) on a road shown highlighted in light green on that map and within 400 m of the midline of such a road, and

(ii) on a road shown highlighted in dark green on that map and within 10 m of the midline of such a road.

Stoyoma Mountain

53   The closure is effective during the period May 1 to November 30 in any portions of M.U.s 3-13 and 3-14 outlined in dashed red on Map No. 1-53/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Barnes Lake

54   The closure is effective year-round in any portion of M.U. 4-23 outlined in red on Map No. 1-54/23, except that a person may use or operate a snowmobile.

Dewdrop-Rosseau Creek Wildlife Management Area

55   The closure is effective year-round in any portion of M.U. 3-29 outlined in red on Map No. 1-55/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Wigwam River

56   The closure is effective year-round in any portion of M.U. 4-2 outlined in red on Map No. 1-56/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Duncan River and Lardeau River

57   The closure is effective year-round in any portion of M.U. 4-30 outlined in red on Map No. 1-57/23, except that a person may use or operate a motor vehicle on a road shown highlighted in green on that map.

Turnagain River

58   The closure is effective during the period May 1 to November 15 in any portion of M.U. 7-52 outlined in dashed red on Map No. 1-58/23, except that

(a) a person may use or operate a motor vehicle if the person accesses the area other than by a road shown highlighted in green on that map, and

(b) in any other case, a person may use or operate a motor vehicle on a road shown highlighted in green on that map and within 400 m of the midline of such a road.

Finlay River

59   The closure is effective year-round in any portions of M.U.s 7-38 to 7-40 outlined in red on Map No. 1-59/23, except that

(a) a person may use or operate a motor vehicle

(i) on that portion of the industrial road shown highlighted in green on that map, and

(ii) on any other industrial road for a commercial purpose other than hunting or a related transportation activity, and

(b) a person may use or operate a snowmobile.

Upper Flathead

60   The closure is effective year-round in any portion of M.U. 4-1 outlined in red on Map No. 1-60/23, except that

(a) a person may use or operate a motor vehicle

(i) on a road shown highlighted in green on that map,

(ii) during the period December 1 to March 31 on a road shown highlighted in yellow on that map, and

(iii) during the periods December 1 to April 30 and June 1 to August 31 on a road shown highlighted in orange on that map, and

(b) during the period November 1 to May 31, a person may use or operate a snowmobile.

Flathead River Eastside, Akamina Creek and Kishinena Peak

61   The closure is effective year-round in any portion of M.U. 4-1 outlined in red on Map No. 1-61/23, except that

(a) a person may use or operate a motor vehicle

(i) on a road shown highlighted in green on that map, and

(ii) during the period June 7 to September 9 on a road shown highlighted in yellow on that map, and

(b) during the period November 1 to May 31, a person may use or operate a snowmobile on a road shown highlighted in purple on that map.

Texas Creek

62   The closure is effective during the period April 15 to November 30 in any portion of M.U. 3-16 outlined in dashed red on Map No. 1-62/23, except that, during the period July 1 to November 30, a person may use or operate a motor vehicle for a commercial purpose other than hunting or a related transportation activity.

Baribeau Creek

63   The closure is effective year-round in any portion of M.U. 4-20 outlined in red on Map No. 1-63/23, except that a person may use or operate a snowmobile for a purpose other than hunting or a related transportation activity.

Ashlu River

64   The closure is effective during the period April 1 to June 15 in any portion of M.U. 2-6 outlined in dashed red on Map No. 1-64/23.

Sims Creek

65   The closure is effective during the period April 1 to June 15 in any portion of M.U. 2-6 outlined in dashed red on Map No. 1-65/23.

Sloquet Creek

66   The closure is effective during the period April 1 to June 15 in any portion of M.U. 2-9 outlined in dashed red on Map No. 1-66/23.

Birkenhead River

67   The closure is effective during the period April 1 to June 15 in any portion of M.U. 2-11 outlined in dashed red on Map No. 1-67/23.

Meager Creek North

68   The closure is effective during the period April 1 to June 15 in any portion of M.U. 2-11 outlined in dashed red on Map No. 1-68/23.
