Local Government Act

Subdivision Parkland Valuation Regulation

Appraiser to determine value

1   Where an owner of land being subdivided and a local government do not agree on the market value of the land under section 510 (6) of the Local Government Act, the value shall be determined by an appraiser appointed jointly by the owner and the local government.

Appointment of appraiser

2   If the owner and the local government fail to agree on an appraiser, the Inspector of Municipalities shall, upon the application of either party, appoint an appraiser to determine the market value.

Cost of appraiser

3   Unless otherwise agreed, the cost of the appraiser shall be borne equally by the owner and the local government.
