Local Services Act

Community Planning Area Number 24: Gulf Islands Subdivision Regulation

Area to which this regulation applies

1   In accordance with the Local Services Act and Order in Council 1171/59, this regulation applies to the following:

(a) Community Planning Area Number 24, the boundaries of which are the same as the Saltspring Island Electoral Area and the Outer Gulf Islands Electoral Area, as described in the amended Letters Patent for the Capital Regional District published in The British Columbia Gazette dated November 2, 1967;

(b) land in the Highland District, except land in Community Planning Area Number 4;

(c) all land on Gabriola Island, Mudge Island, Link Island and De Courcy Island in Electoral Area A, as described in the Letters Patent for the Regional District of Nanaimo published in The British Columbia Gazette dated September 14, 1967;

(d) all land on Valdes, Reid and Kuper Islands in Electoral Area G, as described in the Letters Patent for the Cowichan Valley Regional District published in The British Columbia Gazette dated October 26, 1967;

(e) all land on Read Island in Electoral Area J, as described in the Letters Patent for the Regional District of Comox-Strathcona published in The British Columbia Gazette dated May 5, 1966;

(f) all land on the islands in the Strait of Georgia in Electoral Area A, as described in the Letters Patents for the Powell River Regional District published in The British Columbia Gazette dated January 25, 1968;

(g) all land on all the islands in Electoral Area B and all land on all the islands in Electoral Area F, except the lands on Gambier Island and Keats Island, as described in the Letters Patent for the Sunshine Coast Regional District published in The British Columbia Gazette dated January 12, 1967;

(h) all land on all the islands, except Quadra Island, in Electoral Area J, as described in the Letters Patent for the Regional District of Comox-Strathcona published in The British Columbia Gazette dated December 28, 1967;

(i) all land on Lasqueti Island in Electoral Area D, as described in the Letters Patent for the Powell River Regional District published in The British Columbia Gazette dated January 25, 1968;

(j) all land on all the islands, except Beaver Island, in Electoral Area A, as described in the Letters Patent for the Sunshine Coast Regional District published in The British Columbia Gazette dated January 12, 1967;

(k) all land on all the islands lying within the boundaries of the Islands Trust, as described in Schedule A of the Islands Trust Act, except

(i) land referred to in paragraph (c), and

(ii) all land on Denman and Hornby Islands in Electoral Area A, as described in the Letters Patent for the Regional District of Comox-Strathcona published in The British Columbia Gazette dated December 28, 1967.

Minimum parcel size

2   Subject to section 3, the minimum area of a parcel size into which land may be subdivided is 4.047 hectares.

Minimum parcel size does not apply if otherwise established by local government

3   Section 2 does not apply to land that is subject to

(a) a bylaw of a local government under the Municipal Act or a local trust committee, or the executive committee acting as a local trust committee, under the Islands Trust Act that establishes a minimum area into which a parcel of land may be subdivided, or

(b) another enactment that a body referred to in paragraph (a) is authorized to amend or repeal as if it were a bylaw of that body.
