Regional District Bylaw Approval Exemption Regulation

Definition

1   In this regulation, "Act" means the Local Government Act.

Application

2   (1) This regulation applies to every regional district, except the Greater Vancouver Regional District.

(2) This regulation does not apply to the Islands Trust continued under section 2 of the Islands Trust Act.

Exemption for official community plan amendment

3   A bylaw referred to in section 882 (1) of the Act which amends an official community plan does not require the minister's approval under section 882 (4) of the Act unless the amendment

(a) allows 30 or more new parcels,

(b) allows 30 or more new dwelling units,

(c) applies to 20 ha or more of land, or

(d) applies solely to Crown land.

Exemption for zoning bylaw

4   Sections 913 (1) and (2) of the Act do not apply to a zoning bylaw unless the bylaw

(a) allows 30 or more new parcels,

(b) allows 30 or more new dwelling units,

(c) applies to 20 ha or more of land, or

(d) applies solely to Crown land.
