Contract for Future Services Regulation
Refund under section 18 of the Act
1 (1) For the purpose of section 18 (2) (a) and (b) of the Consumer Protection Act, "portion determined" means
(unused services at the date of cancellation) |
(total services under the contract) |
(2) For the purposes of subsection (1), "unused services" means
(a) the time expressed in days remaining in the term of the contract at the date of cancellation, or
(b) the number of sessions or other service units remaining to be used at the date of cancellation,
and paragraph (a) applies unless the contract is expressed in terms of units to which paragraph (b) clearly applies.
(3) For the purposes of subsection (1), "total services" means
(a) the full term of the contract expressed in days, if subsection (2) (a) applies, or
(b) if subsection (2) (b) applies, the total sessions or other service units provided for during the full term of the contract.
The seller's costs allowance under section 18 of the Act prescribed
2 For the purposes of section 18 (2) (a) of the Act, the "prescribed amount" is 30% of the portion determined of all cash payments made under the contract.
Section 11 (7) of the Act not affected by these regulations
3 Sections 1 and 2 do not apply for the purposes of section 11 (7) of the Act.
Evidence of permanent relocation
4 Where a buyer claims permanent relocation as the basis for cancellation of a contract for future services, the seller may require the buyer to attach to the notice of cancellation a statutory declaration setting out the details of this relocation.
Contract for future services prescribed amount
5 The prescribed amount for the purposes of paragraph (b) of the definition of contract for future services in section 1 of the Act is $50.00.
