Galiano Island Trust Pilot Feasibility Study Regulation

 Definitions

1  In this regulation:

"British Columbia Building Code" means the British Columbia Building Code established under section 2 of the British Columbia Building Code Regulation, B.C. Reg. 295/98;

"building permit" means a building permit granted to a person who qualifies for exemption under this regulation;

"Galiano Island Trust Area" means the local trust area established for Galiano Island under the Islands Trust Act.

 Exemption

2  Subject to section 4, a person who owns property in the Galiano Islands Trust Area and who meets the exemption requirements listed in section 3 is exempt from the provisions of the British Columbia Building Code.

 Requirements for exemption

3  The requirements for an exemption under section 2 are that

(a) the projected building must be

(i)  a single-family dwelling which will be the principal residence of the person exempted when it is completed, or

(ii)  an accessory building to a building described in subparagraph (i),

(b) the person exempted must own the land on which the projected building is to be built,

(c) the person exempted must build, or act as general contractor for, the projected building,

(d) the building project must be in compliance with applicable zoning or building bylaws in force in the Galiano Island Trust Area,

(e) the person exempted

(i)  must apply to the Capital Regional District for a building permit established under section 694 (1) of the Local Government Act, and

(ii)  must not have been granted a building permit under the Local Government Act for building on another property within the Galiano Island Trust Area within the 5 years preceding the date of application under subparagraph (i) for the permit, and

(f) the person exempted must grant a covenant under section 219 of the Land Title Act in favour of the Capital Regional District.

4  A person exempted under section 2 must comply with the requirements of Part 7 and the following articles of the British Columbia Building Code:
