Definition

1   In this regulation, "Act" means the Pharmacy Operations and Drug Scheduling Act.

Health care professions prescribed as practitioners

2   The following classes of persons are prescribed for the purposes of paragraph (b) (i) of the definition of "practitioner" in section 1 of the Act:

(a) midwives;

(b) nurses practising nursing as nurse practitioners, registered nurses or registered psychiatric nurses;

(c) optometrists;

(d) pharmacists;

(e) naturopathic physicians.

Persons who may both prescribe drugs and own pharmacies

3   For the purposes of section 5 (1) of the Act, a pharmacist may be a direct owner or an indirect owner.

When notice of change must be given to registrar

4   A person must give written notice to the registrar under section 7.1 of the Act as follows:

(a) at least 7 days before a manager ceases to manage a pharmacy;

(b) at least 30 days before the location of a pharmacy changes;

(c) at least 30 days before a direct owner changes;

(d) at least 7 days before an indirect owner changes;

(e) on becoming aware that a direct owner has ceased to be eligible, under section 3 of the Act, to hold a pharmacy licence.

When bylaw comes into force

5   A bylaw under section 21 (1) of the Act comes into force on the date that falls 60 days after the date of filing, unless the minister takes an action set out in that section.

Period in which minister may disallow drug schedule regulation

6   The minister may disallow a regulation or a portion of a regulation under section 22 (2.1) of the Act within 60 days after the date of filing.
