Transfer of Assets and Liabilities Regulation

 Definitions

1  In this regulation:

"Act" means the Community Services Interim Authorities Act;

"deferred contributions" means contributions for expenditures that will be incurred in future periods;

"Fraser Region Interim Aboriginal Authority" means the authority known as the Fraser Region Interim Aboriginal Authority, established by the Interim Authorities Regulation, B.C. Reg. 277/2007;

"Vancouver Island Aboriginal Transition Authority" means the authority known as the Vancouver Island Aboriginal Transition Authority, established by the Interim Authorities Regulation, B.C. Reg. 277/2007.

 Transfer to government

2  Pursuant to section 14.1 of the Act, the following assets and liabilities of the Fraser Region Interim Aboriginal Authority and the Vancouver Island Aboriginal Transition Authority are transferred to the government:

(a) current assets in the form of cash;

(b) current assets in the form of accounts receivable

(i)  that are owed to the Fraser Region Interim Aboriginal Authority or the Vancouver Island Aboriginal Transition Authority as of March 31 , 2009, and

(ii)  in the case of any amount in dispute on March 31, 2009, that are anticipated by the Fraser Region Interim Aboriginal Authority or the Vancouver Island Aboriginal Transition Authority as being owed to the Fraser Region Interim Aboriginal Authority or the Vancouver Island Aboriginal Transition Authority;

(c) capital assets consisting of information systems development cost in the form of work in progress and computer equipment;

(d) net assets consisting of investments in capital assets and unrestricted net assets;

(e) records;

(f) liabilities in the form of accounts payable

(i)  that are owed by the Fraser Region Interim Aboriginal Authority or the Vancouver Island Aboriginal Transition Authority as of March 31, 2009, and

(ii)  in the case of any amount in dispute on March 31, 2009, that are anticipated by the Fraser Region Interim Aboriginal Authority or the Vancouver Island Aboriginal Transition Authority as being owed by the Fraser Region Interim Aboriginal Authority or the Vancouver Island Aboriginal Transition Authority;

(g) liabilities in the form of deferred contributions, consisting of restricted contributions provided by the Ministry of Children and Family Development for the development and purchase of capital assets.

Note: this regulation repeals B.C. Reg. 277/2007.
