Advisory council

Definitions

1 In this Act:

"advisory council" means the Building Safety Standards Advisory Council established by section 2;

"appeal board" means the Building Safety Standards Appeal Board established by section 3 and, except in sections 3, 6, 7 and 8, includes a panel established under section 6;

"building" means a structure that is used or intended to be used for the purpose of supporting or sheltering persons or animals or storing property, but does not include

(a) a prescribed structure, prescribed equipment, or

(b) a prescribed portion of equipment in or attached to a structure;

"building code" means the building code under Division 1 of Part 21 of the Municipal Act;

"building inspector" means an inspector appointed by a municipality or a regional district to administer and enforce the building code;

"regulation" does not include a municipal or regional board bylaw that is made under Part XXVII of the Vancouver Charter.

Advisory council

2 (1) The Building Safety Standards Advisory Council is established

(a) to advise and make recommendations to the ministers responsible for the administration of the Municipal Act, Fire Services Act, Electrical Safety Act, Elevating Devices Safety Act, Power Engineers and Boiler and Pressure Vessel Safety Act, Gas Safety Act and Mines Act and Part 3 of the Workers Compensation Act respecting proposed regulations and proposed amendments to regulations where the regulations or the amendments are in respect of the structural design, the materials used in construction, the methods of construction, the alteration, the occupation or the use of a building,

(b) to advise and make recommendations to the appropriate minister respecting the training and qualifications of inspectors, and

(c) to perform other duties required by the minister.

(2) The advisory council is to be composed of members appointed by the Lieutenant Governor in Council, who may designate from among the members a chair and one or more vice chairs.

(3) The members hold office for a term, of up to 3 years, set by the Lieutenant Governor in Council.

(4) At least 1/2 of the members must be persons who are not public service employees within the meaning of the Public Service Act.

(5) Every member who is not a public service employee within the meaning of the Public Service Act may be paid remuneration set by the Lieutenant Governor in Council and must be reimbursed for reasonable out of pocket travelling and other expenses incurred in the discharge of duties.

(6) For the purpose of subsection (1) "inspectors" means

(a) building inspectors,

(b) local assistants referred to in the Fire Services Act,

(c) inspectors appointed or designated under the Electrical Safety Act, Elevating Devices Safety Act or Gas Safety Act,

(c.1) officers within the meaning of section 106 of the Workers Compensation Act and

(d) inspecting power engineers appointed or designated under the Power Engineers and Boiler and Pressure Vessel Safety Act.

(7) Persons necessary to carry on the business of the advisory council may be appointed under the Public Service Act.
