On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the attached Quality Assurance Vehicle Initiative Regulation is made.

QUALITY ASSURANCE VEHICLE
INITIATIVE REGULATION

Definitions

1 In this regulation:

"Act" means the Motor Vehicle Act;

"authorized person" has the same meaning as in section 25.01 [interpretation and application] of the Motor Vehicle Act Regulations;

"designated constable" has the same meaning as in section 1 [definitions] of the Police Act;

"designated inspection facility" has the same meaning as in section 25.01 of the Motor Vehicle Act Regulations;

"designated policing unit" has the same meaning as in section 1 of the Police Act;

"municipal constable" has the same meaning as in section 1 of the Police Act;

"provincial constable" has the same meaning as in section 1 of the Police Act;

"quality assurance vehicle initiative" means an initiative designed to determine whether a designated inspection facility or authorized person complies with the requirements under the Act respecting vehicle inspection and maintenance.

Participation in quality assurance vehicle initiative

2 (1) For the purposes of the participation of persons, vehicles and equipment in a quality assurance vehicle initiative, the director may exempt from the provisions specified in section 4 

(a) the persons specified in section 3, and

(b) all vehicles and equipment operated by those persons.

(2) An exemption under subsection (1) may be unconditional or on any condition the director considers desirable.

Persons who may be exempted

3 For the purposes of section 2, the following persons, and all vehicles and equipment operated by those persons, are specified, when those persons are acting in the course of their duties:

(a) a person employed by or under contract to the ministry of the minister responsible for the administration of the Transportation Act;

(b) a provincial constable or a municipal constable;

(c) a designated constable of a designated policing unit established under the Police Act.

Vehicle and equipment requirements

4 For the purposes of section 2, the following provisions are specified:

(a) section 219 (1) and (3) [equipment of motor vehicles] of the Act;

(b) Divisions 3 [Display and Use of Number Plates], 4 [Lamps], 5 [Brakes], 6 [Brake Regulations Respecting Buses, Trucks, Truck Tractors and Commercial Trailers], 7 [Other Equipment], 7A [Noise from Motor Vehicles], 10 [Commercial Passenger Vehicles], 11 [School Buses], 19 [Miscellaneous], 25 [Vehicle Inspection and Maintenance], 31 [Trailers and Mobile Homes], 40A [Heavy Vehicle Diesel Emission Inspections], 40B [Heavy Vehicle Diesel Emission Control Device] and 44 [Mobility Aid Accessible Taxi Standards] of the Motor Vehicle Act Regulations.
