On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective May 1, 2022,

(a) the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended as set out in the attached Appendix 1, and

(b) the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended as set out in the attached Appendix 2.

Appendix 1

1 Section 2.4 (1) of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended

(a) by adding the following definition:

"allowance" means an allowance under Part III of the Old Age Security Act (Canada); , and

(b) in the definition of "federal one-time payment for seniors" by adding the following paragraph:

(d) a payment under section 7 of the Department of Employment and Social Development Act (Canada) to an individual whose federal guaranteed income supplement or allowance payments were ceased or reduced as a result of the person receiving

(i) an income support payment under the Canada Emergency Response Benefit Act, or

(ii) a benefit under the Canada Recovery Benefits Act.

2 Section 26 (2) (c) is amended by striking out "sections 6 to 10 of Schedule A" and substituting "sections 6 to 8 of Schedule A".

3 Section 66 (1) (b) is amended by striking out "section 2 [monthly support allowance], 4 [monthly shelter allowance], 6 [people receiving room and board] or 9 [people in emergency shelters and transition houses] of Schedule A" and substituting "section 2 [monthly support allowance], 4 [monthly shelter allowance] or 6 [people receiving room and board] of Schedule A".

4 Schedule A is amended

(a) by repealing section 4 (2) to (3) and substituting the following:

(2) The monthly shelter allowance for a family unit other than a family unit described in section 15.2 (1) of the Act is the greater of

(a) the minimum set out in the following table for the family unit, and

(b) the lesser of

(i) the family unit’s actual shelter costs, and

(ii) the maximum set out in the following table for the family unit.

(2.1) The monthly shelter allowance for a family unit described in section 15.2 (1) of the Act is the greater of

(a) the minimum set out in the following table for the family unit, and

(b) the lesser of

(i) the family unit’s actual shelter costs, and

(ii) the maximum set out in the following table for the family unit.

(3) For the purposes of subsections (2) and (2.1), the minimum and maximum monthly shelter allowance amount for a family unit of more than 10 persons is to be calculated as follows:

(a) the minimum is to be calculated by adding $25 for each additional person;

(b) the maximum is to be calculated by adding $50 for each additional person. ,

(b) in section 4 (5) by striking out "subsection (2) (a) or (2.1) (a)" and substituting "subsection (2) (b) (i) or (2.1) (b) (i)",

(c) in section 6 (1) by striking out "section 8 or 9 of this Schedule" and substituting "section 8 of this Schedule",

(d) in section 6 by adding the following subsection:

(3) For the purposes of subsection (1) (a) (i), if the actual cost of room and board is less than the minimum determined under section 4 (2) (a) or (2.1) (a) for the family unit, the actual cost is conclusively deemed to be that minimum. , and

(e) by repealing section 9.

3 Schedule D is amended

(a) by repealing section 4 (1) and (4) and substituting the following:

(1) An applicant is eligible for a shelter allowance for the applicant’s family unit in an amount equal to the greater of

(a) the minimum set out in Table 2 for the family unit, and

(b) the lesser of

(i) the family unit’s actual shelter costs, as calculated in accordance with sections 4 (5) [monthly shelter allowance] and 5 [how actual shelter costs are calculated] of Schedule A, and

(ii) the maximum set out in Table 2 for the family unit.

(4) For the purposes of subsection (1), the minimum and maximum shelter allowance for a family unit of more than 10 persons is to be calculated as follows:

(a) the minimum is to be calculated by adding $25 for each additional person;

(b) the maximum is to be calculated by adding $50 for each additional person. ,

(b) by repealing section 5 (d), and

(c) by repealing Table 2 and substituting the following:

Appendix 2

1 Section 2.04 (1) of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended

(a) by adding the following definition:
