I, Katrine Conroy, Minister of Forests, order as follows:

(a) the Hunting Regulation, B.C. Reg. 190/84, is amended as set out in the attached Appendix 1;

(b) the Limited Entry Hunting Regulation, B.C. Reg. 134/93, is amended as set out in the attached Appendix 2;

(c) effective July 1, 2022,

(i) the Closed Areas Regulation, B.C. Reg. 76/84, is amended as set out in the attached Appendix 3,

(ii) the Designation and Exemption Regulation, B.C. Reg. 168/90, is amended as set out in the attached Appendix 4,

(iii) the Hunting Regulation, B.C. Reg. 190/84, is amended as set out in the attached Appendix 5,

(iv) the Motor Vehicle Prohibition Regulation, B.C. Reg. 196/99, is amended as set out in the attached Appendix 6,

Appendix 1

1 Part 1 of Schedule 7 of the Hunting Regulation, B.C. Reg. 190/84, is amended in item 20.1 in the column entitled "Management Units" by striking out ", 7-58".

Appendix 2

(3) Subsection (1) (a) does not apply to a person hunting with a muzzle-loading firearm in the part of an area described in section 27, 29 or 30 of Schedule 9 that is west of Highway 1 or Highway 19.

Appendix 4

1 Section 16 of the Designation and Exemption Regulation, B.C. Reg. 168/90, is amended

(a) by repealing paragraph (m) and substituting the following:

(m) Mustela richardsonii – short-tailed weasel; , and

(b) in paragraph (o) by striking out "longtailed weasel" and substituting "long-tailed weasel".

Appendix 5

1 The Hunting Regulation, B.C. Reg. 190/84, is amended by adding the following section to Division 5:

Tampering with antlers or horns

15.1 (1) This section applies in relation to the carcass of the following wildlife:

(a) a mountain goat or mountain sheep;

(b) a caribou, deer, elk or moose if, during the season in which the caribou, deer, elk or moose is taken or killed, hunting of the wildlife is restricted based on the number of tines or points on the antlers of that wildlife.

(2) For the purpose of section 36 of the Act, a person who possesses the carcass of wildlife to which this section applies must leave the antlers or horns, as applicable, naturally attached to the upper portion of the skull of the carcass.

(3) An antler or horn that has been altered or tampered with in any way after the animal is taken or killed is not naturally attached for the purpose of subsection (2).

2 Section 16 is amended

(a) in subsection (1) (a) by striking out "4-08, 4-09, 4-14 to 4-17, 4-31 to 4-33, 4-38" and substituting "4-08, 4-09, 4-14 to 4-19, 4-27 to 4-33, 4-37 and 4-38",

(b) by repealing subsection (1) (h) and (i) and substituting the following:

(h) in Region 4, 5 or 8, a lynx,

(i) in Region 4, 5 or 8, a bobcat, or ,

(c) in subsection (1) by adding the following paragraph:

(j.1) in M.U. 6-12 or 6-13, a black bear, ,

(d) by repealing subsection (3.3),

(e) in subsection (4) by striking out "For subsections (1), (2.1), (2.2), (3) and (3.3)" and substituting "For subsections (1), (2.1), (2.2) and (3)", and

3 Section 16.1 (1) (h), (i) and (j) is repealed and the following substituted:

(h) in M.U. 6-12 or 6-13, an elk,

(i) in Region 2 or 3, a bobcat,

(j) in Region 3, 6 or 7, a lynx, .

4 Section 17 (1) is amended by striking out "or" at the end of paragraph (t) and by adding the following paragraphs:

(v) black bear, bobcat, cougar, deer, goat, lynx, sheep, wolf or wolverine with an air rifle that is less than .35 calibre, or

(w) big game, other than an animal referred to in paragraph (v), with an air rifle.

5 Section 18 (1) (r) is repealed and the following substituted:

(r) uses a wireless camera for the purposes of hunting

(i) in Region 1, at any time of the year, and

(ii) in Regions 2 to 8, from August 1 to December 10.

6 Section 19 (5) is amended

(a) by repealing the following parks, recreation areas and protected areas:

(a) those portions of M.U. 1-1 known as the Gulf Islands, other than Gabriola Island;

(b) that portion of M.U. 1-5 being the watershed of the south fork of the Nanaimo River.

9 Part 1 of Schedule 4 is amended

22 (1) The open season for turkey in M.U.s 4-7 to 4-9 and 4-14 to 4-18 from December 1 to December 31 is restricted to private land only.

(2) A person commits an offence if the person kills a bearded turkey in M.U.s 4-1 to 4-9 and 4-14 to 4-40 during the open season from April 15 to May 15 or from September 1 to September 30 and does not, while returning from the hunt, keep the beard of the turkey available for inspection by an officer.

17 Part 2 of Schedule 8 is amended by adding the following section:

Bearded turkey

14.1 A person commits an offence if the person kills a bearded turkey in M.U.s 8-1, 8-9, 8-10, 8-12, 8-14, 8-15, 8-22 and 8-26 during the open season from April 15 to May 15 and does not, while returning from the hunt, keep the beard of the turkey available for inspection by an officer.

Appendix 7

1 Section 3.04 (1) of the Wildlife Act Commercial Activities Regulation, B.C. Reg. 338/82, is amended

(a) by repealing paragraph (a.2) and substituting the following:

(a.2) uses a trap to trap wolves from April 1 to October 14 in Region 4 or in any of M.U.s 3-12, 3-13, 3-17 to 3-20, 3-26 to 3-33, 3-35 to 3-42, 5-1 to 5-6 and 5-12 to 5-14, other than a trap

(i) described in Column 3 of Schedule 3.04, and

(ii) for trapping wolf as listed in Column 1 of Schedule 3.04, ,

(b) by adding the following paragraph:

(g.1) sets a snare, in Region 5, within 10 m of any bait placed by the person, ,

(c) in paragraph (j.2) by striking out "foot snare, killing snare, live box trap, modified foot-hold trap or by means of a killing trap" and substituting "killing snare or live box trap or by means of a trap", and

2 Schedule 3.04 is amended

(g) in subsection (3) (e) by striking out "in Region 4" and substituting "in Region 4, 5 or 8",

(h) by repealing subsection (4) (a) and substituting the following:

(a) the pelt of the fur bearing animal is prescribed, and , and

(i) by adding the following subsections:

(5) A person commits an offence if, outside the open season for a fur bearing animal, the person takes or kills the fur bearing animal by trapping, unless the person complies with subsection (6) as follows:

(a) if the fur bearing animal is a fisher, within 30 days after the fur bearing animal is killed;

(b) in the case of any other fur bearing animal, on or before June 30 of the licence year in which the fur bearing animal is trapped.

(6) For the purposes of subsection (5), the person must submit the following to an officer:

(a) the entire carcass and the pelt of the fur bearing animal;

(b) the location and date of the kill;

(c) the type of trap and set used;

(d) the number of days the trap was set before the fur bearing animal was killed.

Appendix 8

1 Section 4.05 (e) of the Wildlife Act General Regulation, B.C. Reg. 340/82, is amended by striking out "licenced" and substituting "licensed".

2 Section 7.05 is amended by striking out "for purposes of" and substituting "for the purposes of".

3 Section 20.01 (2) is amended by adding the following paragraph:

(b.1) sections 16 (5) and 16.1 (1) of the Hunting Regulation; .

4 The following section is added:

No baiting or feeding – Region 5

23.03 A person commits an offence if the person intentionally baits or feeds an ungulate within 200 m of a dwelling, school yard or playground in Region 5.
