Wildlife Act

Freshwater Fish Regulation

[includes amendments up to B.C. Reg. 74/2017, March 1, 2017]

Interpretation

1   In this regulation, "fish" means a freshwater species of

(a) Order Petromyzoniformes (lampreys),

(b) Class Osteichthyes (bony fishes),

(c) Class Crustacea (crustaceans), or

(d) Class Mollusca

and their eggs and juvenile stages but does not include

(e) goldfish, or

(f) species of ornamental tropical fishes.

Offences

2   A person commits an offence where the person

(a) has in possession,

(b) transports, or

(c) traffics in

live fish unless authorized by a permit or a licence.

Authorization by permit

3   A regional manager or a person authorized by a regional manager may issue a permit in accordance with this regulation on the terms and for the period he or she specifies authorizing a person to

(a) possess,

(b) transport, or

(c) traffic in

live fish.

Fee for authorization by permit

4   The fee for a permit issued under section 3 is $25 and the habitat conservation trust fund surcharge to be paid is $5.
