Definition

1   In this regulation, "Act" means the Adoption Act, R.S.B.C. 1996, c. 5.

Fees for adoption services

2   A prospective adoptive parent must, for a service provided by a director as described in items 1 to 9 of Column 1 of the Schedule, pay the fee opposite that item in Column 2.

Fees for openness agreements

3   An adoptive parent of a child under 19 years of age or a relative of the child must, for a service provided by a director as described in item 10 of Column 1 of the Schedule, pay the fee opposite that item in Column 2.

Fee exceptions

4   Sections 2 and 3 do not apply if the service referred to in Column 1 of the Schedule is in relation to a child

(a) who is in the continuing custody of a director under the Child, Family and Community Service Act or under the guardianship of a director under that Act referred to in section 51 (1) (a) of the Infants Act, or

(b) who comes within paragraphs (a) and (b) of the definition of "designated child" in section 26 of the Adoption Regulation.

Remission of fees

5   (1) Approval of the Lieutenant Governor in Council is given for the remission of the obligation to pay any fee under this regulation if, in respect of the person who must pay the fee, the family unit of which that person is a part has, in the current calendar year, a before-tax annual income equal to or less than the low-income measures established by Statistics Canada for the most recent calendar year for family units of that size plus 10%.

(2) If a person must pay more than one fee under this regulation, "fee" for the purpose of subsection (1) means the sum of all fees payable by that person under this regulation.
