Definitions

1   In this regulation:

"Act" means the Motor Vehicle Act;

"claimed vehicle" means a motor vehicle impounded under the Act and released to the owner of the motor vehicle or a person authorized by the owner;

"unclaimed vehicle" means a motor vehicle impounded under the Act and disposed of under the Act or the Warehouse Lien Act.

Zones

2   The following zones are established:

(a) Zone 1, consisting of the following areas in which impound lots are located:

(i) the City of Vancouver;

(ii) the Corporation of the City of North Vancouver;

(iii) the Corporation of the District of North Vancouver;

(b) Zone 2, consisting of the areas in which impound lots are located in the Capital Regional District, excluding areas that are listed within another zone;

(c) Zone 3, consisting of the following areas in which impound lots are located:

(i) the City of Abbotsford;

(ii) the City of Burnaby;

(iii) the City of Chilliwack;

(iv) the City of Coquitlam;

(v) the City of Kamloops;

(vi) the City of Kelowna;

(vii) the City of Langley;

(viii) the City of Maple Ridge;

(ix) the City of Nanaimo;

(x) the City of Prince George;

(xi) the City of Richmond;

(xii) the City of Surrey;

(xiii) Repealed. [B.C. Reg. 125/2021, s. (a).]

(xiv) the Corporation of the City of New Westminster;

(xv) the Corporation of the City of Port Coquitlam;

(xvi) the Corporation of the City of White Rock;

(xvii) the Corporation of the Township of Langley;

(xviii) the District of Mission;

(xix) the District of Squamish;

(xx) the Resort Municipality of Whistler;

(xxi) the City of Delta;

(d) Zone 4, consisting of the following areas in which impound lots are located:

(i) the Corporation of the District of Central Saanich;

(ii) the District of North Saanich;

(iii) the District of Sooke;

(iv) the unincorporated community of Port Renfrew;

(v) Saltspring Island;

(vi) the Town of Sidney;

(vii) all other areas located within British Columbia that are not listed within another zone.

3   The following fees, costs, charges and surcharges are prescribed for the purposes of section 255 (2) (a) [storage of impounded motor vehicle] of the Act:

(a) for storage,

(i) $23.28 per day for impound lots in Zone 1,

(ii) $22.22 per day for impound lots in Zone 2,

(iii) $20.11 per day for impound lots in Zone 3, and

(iv) $15.87 per day for impound lots in Zone 4;

(b) for towing, the towing cost determined under section 4;

(c) for administration,

(i) $55.05 for a claimed vehicle, and

(ii) $70.09 for an unclaimed vehicle.

Towing cost

4   (1) For the purposes of section 3 (b), the towing cost is the sum of the following:

(a) the basic towing cost determined in accordance with subsection (2) of this section;

(b) a fuel surcharge equal to 13% of the basic towing cost;

(c) if the towing distance is more than 32 km, a charge for the use of dollies in the amount of

(i) $0.43 per km for each km towed on a paved highway, and

(ii) $0.63 per km for each km towed on an unpaved highway.

(2) The basic towing cost for a vehicle with a gross vehicle weight within a range described in column 2, 3, 4 or 5 of the following table is the cost set out in or determined in accordance with that column, opposite the applicable towing distance described in column 1.

(3) In determining an amount in accordance with subsection (1) (c) or in accordance with columns 2 to 5 in items 2 to 4 of the table, the towing distance is to be expressed to the nearest tenth of a kilometre.
