Transitional Official Duties Expense Regulation

 Definitions

1  In this regulation:

"amended regulation" means the Official Duties Expense Regulation, BC Reg 226/2001, as amended on October 30, 2007;

"official" means an official as defined in the amended regulation;

"official duties" means official duties as defined in the amended regulation.

 Transitional expenses

2  (1)  The amended regulation applies with respect to claims made under that regulation by an official on or after October 30, 2007 for

(a) expenses incurred by the official on or after October 30, 2007 or allowances payable in relation to official duties performed on or after October 30, 2007,

(b) expenses incurred by the official on or after July 1, 2007 but before October 30, 2007, if the official would have been entitled to have those expenses reimbursed under the amended regulation if that regulation had been in force on July 1, 2007, and

(c) allowances payable in relation to official duties performed on or after July 1, 2007 but before October 30, 2007, if the official would have been entitled to have those allowances paid under the amended regulation if that regulation had been in force on July 1, 2007.

(2)  If an official received compensation under the Official Duties Expense Regulation before October 30, 2007for expenses incurred on or after July 1, 2007 but before that regulation was amended on October 30, 2007, the official may not claim an amount for those expenses under the amended regulation that is more than the difference between the amount paid and the amount permitted under the amended regulation.

(3)  If an official received an allowance under the Official Duties Expense Regulation before October 30, 2007 for official duties performed on or after July 1, 2007 but before that regulation was amended on October 30, 2007, the official may not claim an allowance under the amended regulation with respect to those official duties that is more than the difference between the amount paid and the amount permitted under the amended regulation.

(4)  Subsections (2) and (3) apply only if the compensation or allowance paid to an official before October 30, 2007 is less than the amount that is payable in the same circumstances under the amended regulation.
