Land Act; Motor Vehicle (All Terrain) Act
[includes amendments up to B.C. Reg. 546/2004, December 31, 2004]
Whereas the recreational and wildlife values of the Babine Mountains are recognized as being significantly high;
And whereas the alpine and subalpine of the Babine Mountains vegetation are recognized as being fragile and subject to serious and long term ecological damage should motorized vehicles be permitted to travel upon it;
And whereas the quality of the recreational and wildlife values could degenerate if motorized all terrain vehicle access is permitted in the alpine zone of the range;
And whereas actual damage to the alpine and subalpine terrain of the Babine Mountains has been observed:
1 The use of any all terrain vehicle without the issuance of a permit be prohibited within the area outlined in red on the attached map.

2 The use of any all terrain vehicle other than a snowmobile without the issuance of a permit be prohibited within the area outlined in green on the attached map.

3 For the purpose of this regulation:
(a) "all terrain vehicle" means any type of vehicle propelled by motorized power and capable of travel on or off a highway as defined in the Transportation Act;
(b) "snowmobile" means a vehicle weighing not more than 1 000 pounds, designed primarily for travel on snow or ice having one or more steering skis and self-propelled by means of an endless belt or belts driven in contact with the ground;
(c) "permit" is a permit issued by the Land Management Branch specifying terms and conditions for the use of Crown land.
