Interpretation

1In this regulation:

"antique motor vehicle", "collector motor vehicle", "golf cart", "gross vehicle weight", "snowmobile" and "snow vehicle" have the same meaning as in section 1 of B.C. Reg. 26/58, the Motor Vehicle Act Regulations;

"model year" has the same meaning as in Division 29 of B.C. Reg. 26/58, the Motor Vehicle Act Regulations.

Classes of motor vehicles exempt from
emission inspection certification

2The following classes of motor vehicles are exempt from the requirement to be certified for motor vehicle compliance under section 48 of the Motor Vehicle Act:

(a)a motor vehicle or motor home, other than a commercial vehicle under paragraph (b), if the vehicle is greater than 3 500 kg net vehicle weight and is powered by gasoline, gaseous fuels (alternate fuels) or diesel fuel;

(b)a commercial vehicle if the vehicle is greater than 5 000 kg gross vehicle weight and is powered by gasoline, gaseous fuels (alternate fuels) or diesel fuel;

(c)a vehicle, not previously registered, that is registered and licensed for the first time in British Columbia;

(d)a vehicle previously registered and licensed in British Columbia if the vehicle is from the current model year, the previous 3 model years, or the next model year;

(d.1)Repealed. [B.C. Reg. 51/93.]

(e)a motor cycle;

(f)a vehicle with fuel type (code):

Electric (E);

(g)a vehicle that is licensed as:

Agriculture vehicle (AGR),

Antique motor vehicle,

Collector motor vehicle,

Farm fleet vehicle (FFL);

(h)a vehicle with body style (code):

Classes of motor vehicles subject to temporary
exemption from emissions inspection

2.1The following classes of motor vehicles are exempt from the requirement to be certified for motor vehicle compliance under section 48 of the Motor Vehicle Act for the period, and on the conditions, specified:

(a)a vehicle that has failed the emissions test if

(i)the failed vehicle has not been issued with a licence under section 50 (4) of the Motor Vehicle Act,

(ii)the owner of the failed vehicle transfers the licence from another vehicle to the failed vehicle and the transferred licence has a term of less than 4 months remaining on it, and

(iii)the failed vehicle does not receive 2 consecutive exemptions under this paragraph;

(b)an unlicensed vehicle newly purchased outside rating territory D, E or H, for a period not to exceed 12 months from the date of purchase;

(c)a vehicle licensed in British Columbia that is located outside rating territory D, E or H at the time of the licence renewal, for a period not to exceed 3 months and only once in a 12 month period;

(d)and (e) Repealed. [B.C. Reg. 403/2000.]

(f)an even numbered model year vehicle, that is a 1992 model year or a newer model year vehicle, for the period from January 1, 2001 through December 31, 2001, if the inspection result in the previous year was a pass or a conditional pass.

Areas of British Columbia in which motor vehicles
are exempt from emission inspection certification

3A motor vehicle is exempt from the requirement to be certified for motor vehicle compliance under section 48 of the Motor Vehicle Act if the vehicle is registered and licensed in insurance rating territory F, G, L, N, P, R, S, V, W, X, Y or Z as prescribed in Table 3 of Schedule 1 of B.C. Reg. 447/83, the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act.

Aircare

4Insurance rating territory H as prescribed in Table 3 of Schedule 1 of B.C. Reg. 447/83 is specified for the purposes of section 50 (1.2) of the Motor Vehicle Act.

January 2000 exemption

5If, during the month of January, 2000, the president or a vice president of the Insurance Corporation of British Columbia declares that the Insurance Corporation of British Columbia or the Greater Vancouver Transportation Authority is unable to perform, record or communicate certification for motor vehicle compliance under section 48 of the Motor Vehicle Act because of a system failure that affects the corporation or authority, all motor vehicles are exempt from the programs described in section 50 (1) and (1.2) of the Motor Vehicle Act, from the date of that declaration until February 1, 2000.
